Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Tempo mobile application and related websites (collectively, "Tempo" or the "Service") operated by DailyEnigma, LLC ("DailyEnigma," "we," "us," or "our"), a Delaware limited liability company.
By downloading, accessing, or using Tempo, you agree to these Terms. If you do not agree, do not use the Service. For privacy practices, see our Privacy Policy. Questions: ai@everflamedesign.com.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use Tempo. If you use Tempo on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. The Service
Tempo provides reading and focus-training tools, including paced reading sessions, comprehension checks, progress tracking, document upload/library features, and related insights. Features may change over time. We may update, suspend, or discontinue parts of the Service with or without notice.
3. Accounts
You may need an account to use certain features. You are responsible for maintaining the confidentiality of your login credentials and for activity under your account. Notify us promptly at ai@everflamedesign.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.
4. Subscriptions and billing
Some Tempo features require a paid subscription ("Tempo Pro" or similar). Subscriptions purchased through the Apple App Store or Google Play are billed by Apple or Google under their terms and payment methods.
- Subscriptions may auto-renew unless canceled before the end of the current period in your Apple or Google account settings.
- Prices, plan lengths, and available offers may change; any change affecting renewal will be handled according to platform rules and applicable law.
- Refunds, billing disputes, and cancellation mechanics for store-purchased subscriptions are generally handled by Apple or Google, as applicable.
- Deleting the app does not automatically cancel a subscription — you must cancel through the relevant store account settings.
5. License and intellectual property
Subject to these Terms, DailyEnigma grants you a limited, non-exclusive, non-transferable, revocable license to use Tempo for your personal, non-commercial use. We and our licensors own all rights, title, and interest in Tempo, including software, branding, design, text, and other content (excluding content you upload). You may not copy, modify, reverse engineer, redistribute, or create derivative works from Tempo except as allowed by law.
6. Your content
You retain ownership of documents and materials you upload ("User Content"). You grant DailyEnigma a limited license to host, process, and display User Content solely to operate and improve the Service for you. You represent that you have the rights needed to upload User Content and that it does not violate law or third-party rights.
7. Acceptable use
You agree not to:
- Use Tempo for unlawful, harmful, or fraudulent purposes;
- Interfere with or disrupt the Service or its infrastructure;
- Attempt unauthorized access to accounts, systems, or data;
- Upload malware or content that is illegal, infringing, or abusive;
- Scrape, harvest, or misuse Tempo in ways that degrade performance or violate these Terms;
- Misrepresent your identity or affiliation in connection with Tempo.
8. Third-party services
Tempo may rely on third-party services (including app stores, cloud hosting, authentication, and payment processors). Your use of those services may be subject to their terms and privacy policies. We are not responsible for third-party services we do not control.
9. Disclaimers
TEMPO IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAILYENIGMA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT TEMPO WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESULTS (INCLUDING READING SPEED OR COMPREHENSION OUTCOMES) WILL MEET YOUR EXPECTATIONS. TEMPO IS AN EDUCATIONAL/TRAINING TOOL AND IS NOT MEDICAL, PSYCHOLOGICAL, OR PROFESSIONAL ADVICE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAILYENIGMA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF TEMPO. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR TEMPO IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.
11. Indemnification
You agree to defend, indemnify, and hold harmless DailyEnigma and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of Tempo, or your violation of these Terms or applicable law.
12. Termination
You may stop using Tempo at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your license ends and you must stop using Tempo. Sections that by their nature should survive (including intellectual property, disclaimers, limitations of liability, and governing law) will survive.
13. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Except where prohibited, you agree that courts located in Delaware will have exclusive jurisdiction over disputes arising from these Terms or the Service.
14. Changes to these Terms
We may modify these Terms from time to time. We will post the updated Terms on this page and update the effective date. Continued use of Tempo after changes become effective constitutes acceptance of the revised Terms, except where applicable law requires otherwise.
